College sports has become an out of control billion dollar industry which have taken over the academic institutions which they represent. In order to reign back in this out of control monster i propose the following law to regulate college
sports.
SAVING COLLEGE SPORTS 2014
The following law will apply to all public universities and colleges, any school that competes with a public university or school or who travels across state lines to compete or who accepted federal or state tax dollars.
1) Anyone who knowingly provides financial reward beyond that allowed by the agreed limits set forth by the governing body of college sports shall be guilty of a crime punishable by a fine of $100,000 and imprisonment for no less than 2 years and no more than 5 years.
2) Anyone who knowingly assist a college athlete to commits academic fraud be it by knowingly awarding or changing an unearned grade to make or keep the athlete eligible or knowingly helps the student to commit fraud in testing to gain admittance to or remain at a college or university will be guilty of a crime punishable by a fine of $100,000 and imprisonment of no less than 2 years or more than 5 years.
3) Any representative of any college athletic program be it a booster or an college/University employee who knowingly breaks recruitment rules concerning extra benefits of a non financial nature shall be guilty of a crime punishable by a fine of $50,000 and will be banned from any association with college athletics or athletes for a period of no less than 5 years up to a lifetime ban in case of multiple violations with in a 3 years period.
4) Any institution which violates the recruitment rules and signs a player will lose use of that scholarship for a period of 4 years. In case of multiple violations there will be a loss of scholarship for 4 years for EACH violation up to 50% of the allowable scholarships in place at the time of this bill becoming law.
5) Any institution found violating the rules of extra benefits or engages in academic fraud to keep the student eligible once a player arrives on campus shall lose that players eligibility to compete and will lose the use of that scholarship for recruiting a new athlete for a period of 4 years. The current player shall lose eligibility for competition but remain on scholarship as long as they retain academic eligibility for a period of 4 years from the day they first entered the institution. In case of multiple violations there will be a loss of scholarship for 4 years for EACH violation up to 50% of the allowable scholarships in place at the time of this bill becoming law.
6) Any institution that awards a scholarship to an athlete and that athlete leaves due to either academic ineligibly or to enter pro sports before the end of their 4th year in college. the institution will lose use of that scholarship for a period equal to the time which the player would have completed his 4th year at school. In case of multiple violations there will be a loss of scholarship for EACH violation up to 50% of the allowable scholarships in place at the time of this bill becoming law.
7) Any student who knowingly or has a representative who ask for or receives benefits other than those allowed by the governing body of college sports shall lose eligibility permanently and will not be able to enter college on scholarship or compete on any college team. Anyone who ask for or receives extra financial benefits for himself or a representative or family member shall be guilty of a crime punishable by imprisonment of no less than 2 or more than 5 years.
8) Any student that knowingly engages in academic fraud to get or remain eligible shall be permanently ineligible for competition but will remain on scholarship for the remainder of their four years as long as they meet school eligibility requirements which all students are required to meet. Unless the school expels them for academic fraud. If expelled any school official who participates knowingly in the fraud will be dismissed.
9) Any student who leaves before the end of their 4th year in college to enter professional sports shall repay the college's general scholarship fund in the following ratio. Leaving after 1 years the athlete shall pay the school's general scholarship fund 20% of their gross earnings from their first contract including bonuses and delayed payments. Leaving after two years the player will pay the school's general scholarship fund 10% of their gross earnings from their first contract including bonuses and delayed payments. Leaving after three years the player will pay the school's general scholarship fund 5% of their gross earnings from their first contract including bonuses and delayed payments. These funds can ONLY be used for general scholarships and cannot be used for athletics. The value of the contract will include any payments that were designed deliberately or not to backload payments in order to get around this provision of the law. Any college who knowingly tries to manipulate these funds and funnel them to athletic use will lose 4 scholarships for a period of four years for each violation up to 50% of scholarships allowed and face the loss of all federal money other than student loans and Pell grants. Each violation will also lead to a fine of $100,000 from their athletic budget.
10) All schools shall have the exact same requirements to compete in post season. No post season competition shall be able to guarantee any post season spot to any athletic conference unless all athletic conferences are offered the same deal under the same requirements. Football bowl games may agree with only one conference to bring the conference champion to their game. No conference can have an agreement with more than 3 bowl games to guarantee a spot for their conference members. No conference shall send more than 40% of their teams to post season unless there are not enough eligible teams in other conferences to fill the field. Conferences may not reach an agreement to crown a national champion in any sport unless ALL conference champions have equal access and meet equal requirement for eligibility. Any violation of the equal access provision will result in violating conferences losing ALL monies from post season for each year the conference is in violation. Two violations of this provision in 5 years or 3 in ten years will make the conferences and all their school ineligible for post season competition.
11) All post season money will be split equally between all schools competing in the classification with the competing schools getting a double share. The extra share will be split between the school and the conference on a 55-40-5 split with the 55 going to the school. IE if Middle Tn and SMU were to play in a bowl with a payout of $30 million. The $30 million will be split equally between each FBS school with the SMU and Middle TN getting an extra share. Of that extra share 55% would go to SMU and the other 40% to remaining AAC teams and 5% going to AAC. Likewise the extra share Middle Tn would be split the same way. The primary share given to each team would be split 95% going to each school and 5% going to their conference.
12) All athletic conference shall exist of no less than 8 members and no more than 12 members. This will include part time members. If a school does not compete in a particular sport it shall not be eligible for the split of revenue from that sport. Seniority shall be the primary guideline in reducing conference size for those over 12 teams.
13) Any institution which has more than 3 violations of this law in a 5 year period or 5 violations in a 10 year period will be ineligible for post season competition and TV appearances including their own TV network.
